Terms and Conditions

Photo Booths:

 

1. A 50% non refundable deposit is required to reserve the event date. The balance is payable, in full, 1 month before the event.

 

2. Mirrored Memories Ltd. T/A Major Moments Photography (herein known as Major Moments Photography or Major Moments) will arrive at the venue approximately 40 minutes early to ensure the successful set up and operation of the equipment.

 

3. It is the responsibility of the customer to secure permission for the set up and running of a photo booth with the venue management.

 

4. It is the responsibility of the customer to ensure that location of where the photo booth will be set up, is easily accessible and stair free. The booth is 85kg, we need either a lift or ramp, we can lift the booth max 5 steps.

 

5 . It is the customer’s responsibility to advise Major Moments Photography of any restrictions, access or parking issues that could adversely affect the performance of the booth or booth operator. The photo booth’s dimensions are H 1. m L 2.2m W 1. m. The customer understands that any such restrictions may adversely affect the experience of the event or the quality of the images produced. Major Moments Photography is not responsible for the consequences of such restrictions.

 

6 . The customer will ensure there is a 13 amp power supply adjacent to the area the booth will be sited.

 

7 . Major Moments Photography guarantees the equipment will be operational for at least 80% of the rental period. Any downtime in excess of this will be refunded on a pro-rata basis if this is caused by technical or mechanical difficulties.

 

8 . Major Moments Photography is not responsible for difficulties caused by the event venue’s wifi connectivity.

 

9 . If Major Moments Photography fails to comply with the terms of this agreement they shall only be liable for funds received. They shall not be liable for any further consequential damages.

 

10 . The customer agrees to indemnify Major Moments Photography against any liability from any claims, actions, suits, costs or damages including but not limited to liability for personal injury of any person at the event or any damage to property.

 

11. Major Moments Photography reserves all rights to the photographs captured during the event and may use for demonstration, publication, or other purposes. Original media and copyrights remain the exclusive property of Major Moments Photography.

 

12. Any special requests should be made and agreed in writing by both parties before the event.

 

13. Any modification of this agreement should be made in writing and signed by both parties.

 

14. Payments are non refundable upon cancellation of the event. They may be reapplied subject to availability if the event is rescheduled within 7 days of booking.

 

15. If Major Moments Photography cancels the contract due to illness or the customer violates any terms of this agreement, Major Moments Photography may refund all or a portion of the fees already received. Any fees paid for services/ products already completed will not be refunded.

 

16. Any failure to make timely payments may result in cancellation of this agreement. Major Moments Photography will make every attempt to provide notice to the customer before cancellation occurs.

 

 

17. Whilst the Major Moments Photography team will encourage your guests to make use of the booth, including making announcements during the event and approaching your guests individually, Major Moments Photography cannot force guests to make use of the booth and, as such, does not guarantee a minimum number of prints.

 

18. With regards to covid, if the government state your event cannot take place or you have had to reduce your event extensively, i.e 80 guests down to 30 guests. You are entitled to change dates, we would look to move with you, if we cannot do your new date, you would be entitled to a full refund.

TERMS AND CONDITIONS OF BUSINESS

THE PHOTOGRAPHER

The Principle photographer will be one of our top photographers from Major Moments. If the client chooses to add a second photographer, this will be at the choice of Major Moments. They will be the only professional photographers with any remit of any kind whatsoever given by the Bride and Groom to record the day. We want to give you the best photographs and not be in competition to do so.

 

IMAGES

Any images or copies of images whether stored digitally or otherwise and any computer program including and source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. The photographers grant the Bride and Groom permission to make copies of the images under the following conditions. The images taken by the photographer are for personal use by the Bride and Groom and their friends and relatives. Selling, Publication or any Commercial use of the photographs is not allowed without prior written agreement from the photographer. This includes any forwarding of the images to the cake-maker, florist, band, venue or any other third party supplier. If any of the third parties request images of their work, which is highly likely to be used for commercial advertising, the Bride and Groom must insist they contact Major Moments directly.

 

PRE-WEDDING CONSULTATION AND ENGAGEMENT SHOOT

The consultation usually happens at the time of the Engagement Shoot. The Bride and Groom will bring a timetable of the day and outline broadly what is required. The photographers will advise on planning, logistics and timings where needed. In terms of booking your Pre Wedding Shoot, which is always included in the Wedding Package, Major Moments cannot always guarantee a specific date but will always do what we can to find a suitable date for all parties involved prior to the Wedding. The Engagement Shoot should be within 30 miles from the venue unless agreed otherwise. If required the Bride and Groom can arrange another meeting before the Wedding to iron out any last details. Major Moments will always contact a week before the Wedding to ensure that there have been no last minute details.

 

COOPERATION

The Bride and Groom and Major Moments consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this agreement.

 

FAMILY GROUPS AND ORGANISATION

We strongly recommend that Major Moments is provided with an assistant (usually the Best Man or an Usher who is a family member) who will identify key individuals, especially in organising the key family group photographs. Major Moments cannot be held responsible for the omission of a Family Group photograph whereby the individuals needed for the photograph are not present at the specific time. The Family Group photographs are the clients opportunity to ensure any vital Wedding guests or family members are represented within the Wedding Photographs, if these vital Wedding guests are not included at this stage, we cannot absolutely guarantee they will appear in the final set of photographs, although we do make great effort to ensure maximum coverage of guests throughout the day. Please note the Family Group photographs occur during reception, and as such we are unlikely to provide any photographs of the Reception. The Bride and Groom either personally or through an Usher or Toast Master, also agree to give Major Moments sufficient warning of key events at the Wedding to give the photographer time to prepare, for example, Bouquet throwing, cutting the cake, speeches or any surprises

 

THE SCHEDULE

Our shooting schedule, style of work and experience are designed to achieve a great set of Wedding Photographs for the Bride, Groom and their families. Both the Bride and Groom and Major Moments therefore agree that punctuality and cheerful operation are essential to produce outstanding photographic results. In cases where the wedding does not run on time (for example extreme lateness by the Bride arriving to the ceremony) we cannot guarantee to take our normal set of photographs, although in such circumstances we will do our absolute best to compensate at other times of the day.

 

WEDDING GUESTS

All your guess will have digital cameras and all your guests will want to photograph the Bride and Groom. In the spirit of cheerful operation the Bride and Groom agree to give Major Moments precedence over your guests in order to take the photographs required for the Wedding Photography. We use all our discretion and experience to politely request certain guests make way for the official Photographer, but we cannot be held liable for lack of Wedding Photographs if guest taking their own photographs of the Bride and Groom have continually interrupted the photographers work. We absolutely insist that during the Family Group Photographs, not other family members are taking photographs - from experience this simply serves to distract those in the photograph, resulting in family members staring at other cameras around the room causing the process to take considerably longer. The Bride and Groom must support this policy and those selected for the Family Group photographs must be informed beforehand.

 

HOUSE RULES

Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some officiants will insist the photographer shoots from a specific location. In such circumstances, the Bride and Groom agree to accept the technical limitations that may be imposed on the equipment used of the location from which we can photograph. We advise the Bride and Groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

 

TREATMENT OF PHOTOGRAPHERS ON THE DAY

The Bride and Groom agree to provide a meal for each of the photographers present on the day. Professionalism and maintaining our professional image is vitally important to us, as is showing only the utmost respect for every single guest at the Wedding. We do require a similar level of respect to be shown to us on the day. Our staff must be able to work in respectful and safe conditions and we reserve the right to make an official complaint to the Bride and Groom if any incidents occur. If such incidents continue to occur, we reserve the right to cease working on the day.

 

LIMIT OF LIABILITY

The primary photographer will be agreed upfront. If your primary photographer is too ill, injured or must attend any personal emergency such as family bereavement and cannot supply the Wedding Photography Services specified, Major Moments will attempt to get a replacement second Wedding Photographer. The professional second photographer from Major Moments is present and fully briefed for the wedding anyway they will then shoot the day on their own. They will work to the best of their ability. If both your primary photographer and the professional second photographer are unavailable and a replacement photographer cannot be found then liability is limited to a full refund of any payments received In the extremely unlikely event of a total photographic failure or cancellation of either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contact. Neither party shall be liable for the indirect or consequential loss. The photographers have working methods in place to prevent the loss or damage to your images. However there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part there of according to the percentage of images supplied and the percentage of images lost.

 

CANCELLATION OF THE WEDDING

In the event of the Bride and Groom cancelling the Wedding for whatever reason the Booking Fee is non refundable. If the Wedding is cancelled within 28 days of the set date, the remainder of the fee paid is also non refundable. It will be considered liquidated damages to Major Moments.
